1. These Terms and Conditions will apply to the purchase of goods (digital products) by you (the customer, or you) from genuine-english.com (the supplier, us, we).

3. These are the terms on which we sell all goods to you. By ordering any of the goods, you agree to be bound by these Terms and Conditions. You can only purchase the goods from the website if you are eligible to enter into a contract and are at least 18 years old.

• iii. In the case of digital products made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.

Some or all of your personal and financial details may be processed by third parties when you purchase a product from the genuine-english.com shop. All details regarding this can be found either within our privacy policy or in the individual privacy policies of the third party companies which process transactions on our website. The details of the third party companies who process transactions and therefore may process your personal and financial data will be available to you at the point of sale.
• ii. genuine-english.com does not keep a record of your financial details and to the best of our knowledge does not have access to any financial information inputted into our online shop.

• iv. We may contact you by using your email or other electronic communication methods and by pre-paid post and you expressly agree to this.
• v. By using the website (including paying for products and services), you agree to the terms outlined in the Privacy Policy and various other legal statements available in the legal statements section of the website.

6. Basis of sale. 

• i. The description of goods in our website does not constitute a contractual offer to sell the goods. When an order has been submitted on the website, we can reject it for any reason, although we will try to tell you the reason without delay.
• ii. The order process is set out on the website. Each step allows you to check and amend any errors before submitting the order. It is your responsibility to check that you have used the ordering process correctly.
• iii. A contract will be formed for the goods ordered only when you receive an email from us confirming the order (Order Confirmation). You must ensure that the order confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the order placed by you. 7. Price and Payment.

• i. The price for the goods and any additional delivery or other charges is that set out on the website at the date of the order or such other price as we may agree in writing.
• ii. You must pay by submitting your credit or debit card details when you order and we can take payment immediately or otherwise before the delivery of the goods.
• iii. You can also pay using PayPal.
• iv. From time to time and at our discretion, we accept bank transfers for goods, in which case, you will receive an invoice with our bank account details. You can make the payment using your online banking app or by visiting your local bank branch. Upon payment, you will receive a receipt of payment and the digital goods will be sent to you via email. 


8. Delivery of digital products.

• i. Digital products are delivered to you automatically via unique download links.

1. The lifetime of the link will be set at 72 hours. This means that you must download the digital product via the link within 72 hours of making the purchase.

                       i) Should you require more time to download the link, please contact us prior to making the payment and we will make the necessary                            adjustments to the lifetime of the link.

                       ii) If you fail to download the digital product using the link, please contact us, and we will endeavour to find an alternative method for                            delivering the digital product to you (e.g. via email). 

        2. You will have a limit of 3 attempts to download your digital product per purchase.

                       i) Should you fail to download the digital product within 3 attempts, please contact us and we will endeavour to find an alternative                                  method for delivering the digital product to you (e.g. via email).

        3. Please ensure that you are using up-to-date systems and fully functioning technological devices when you download digital products from              this website. We take no responsibility for failed downloads or poorly functioning digital products if the reason for this is down to the                          improper/poor functioning of the customer’s systems and/or technological devices or any other issues at your end.
 

9. Risk and Title.

• i. Risk of damage to, or loss of, any goods will pass on to you when the goods are delivered to you.
• ii. The digital products you purchase are protected by copyright. When you purchase a digital product from us you are granted a limited, non-exclusive, non-transferable, non-sub-licensable licence to hold the digital product on your digital devices and use it for your own personal use. The licence granted to you does not give you any rights to the content (including any material that we may licence from third parties to produce the content).
• iii. You may print the digital products, but only enough copies necessary for your own personal use.
• iv. You may not copy, rent, sell, publish, republish, share, broadcast, or otherwise transmit the digital product (or any part of it) or make it available to the public except as permitted under the Copyright Designs and Patents Act 1988 (Chapter 3 ‘Acts Permitted in Relation to Copyright Works’. This includes a prohibition on making any visual or audio recordings of the content.

10. Returns policy.

• i. We do not process refunds for digital products when the customer has already attempted to download the product.

1. As a consumer, you have a legal right to a “cooling-off” period within which you can cancel the order and request a full refund for any reason, including if you have changed your mind. The period begins once we have sent you the order confirmation email and ends when you attempt to download the digital product, or 14 calendar days after the date of our order confirmation, whichever occurs first. 


• ii. By law, we must provide digital products that are of satisfactory quality, fit for purpose, and as described. If a digital product available through the website does not meet these standards, please contact us as soon as reasonably possible to inform us of the problem. Your available remedies will be as follows:

1. If the digital product has faults, you will be entitled to a repair or a replacement
2. If we cannot fix the problem, or if it has not been or cannot be fixed within a reasonable time and without significant inconvenience to you, you may be entitled to a full or partial refund.

• iii. If you have made a purchase by mistake, please inform us within 14 days of making the purchase.

1. Do not attempt to download the digital product. If you attempt to download the product you will not be able to receive a refund.
2. Provided you have not attempted to download the digital product, we will be able to cancel the order and issue a full refund.
3. Please contact hello@genuine-english.com if you wish to inform us that you have made a purchase in error and would like a refund. Please state your name, email address, order number, and the date/time you ordered the product/s so that we can locate your purchase on our system.
4. Refunds will be processed no later than 14 calendar days from the the day on which you inform us that you have made a purchase in error and would like a refund.
5. Refunds will be made using the same payment method that you used when purchasing your digital product/s.

11. Complaints procedure.

• i. genuine-english.com prides itself of delivering fantastic products at a fair price. If you are dissatisfied with the product/s you have received for any reason, please write your complaint to hello@genuine-english.com . We will respond to your complaint within 72 hours and try our best to come to an agreement on how best to proceed. 

• ii. In the unlikely event that you are still dissatisfied after communicating with genuine-english.com , it is advisable that you consult The Consumer Rights Act 2015 at the following link: https://commonslibrary.parliament.uk/faulty-goods-digital-content-services/ . Here you will be able to learn more about your consumer rights and the possible options you have regarding your complaint.

• iii. The contract (including non-contractual matters) is governed by the law of England, Wales, Scotland, and Northern Ireland.

• i. Your privacy is critical to us. We respect your privacy and comply with the General Data Protection Regulation with regard to your personal information. 

• ii. These terms and conditions should be read alongside, and are in addition to our policies, including our privacy policy, and cookies policy (available in the legal statements section of our website). 

• iii. For the purposes of these Terms and Conditions: 


1. ‘Data Protection Laws’ means any applicable law relating to the processing of Personal Data, including, but not limited to the GDPR. 

2. ‘GDPR’ means the UK General Data Protection Regulation 

3. ‘Data Controller’, ‘Personal Data’, and ‘Processing’ shall have the same meaning as in the GDPR.

14. General.

If any court or competent authority finds that any provision of these terms and conditions of sale (or part of any provision) is invalid, illegal, or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this privacy policy will not be affected.
