For example: A lesson is booked and confirmed to begin at 1200 and end at 1300. If the student does not attend the lesson until 1210, it does not mean that the lesson will be until 1310. The lesson will be until 1300 as originally planned.

14. Teacher absence or lateness

  • i. Your teacher will make every effort to attend the lesson at the time you have mutually agreed; however, there may be circumstances in which the teacher will be absent or late.

  • iii. If your teacher has not started the call within 10 minutes of the scheduled lesson time, and has given you no warning of their potential lateness/absence, please contact hello@genuine-english.com.

For example: The teacher is 10 minutes late and the student and teacher agree to extend the lesson by 10 minutes. If the student cannot extend the lesson that day, the teacher will offer to add 10 minutes to a future lesson.
  • v. In the event that a teacher is absent, the lesson will be considered to be incomplete and the lesson will be rescheduled to a time in the future.
  • vi. You can raise a complaint regarding a teacher’s lateness or absence by contacting hello@genuine-english.com. All complaints will be taken very seriously and we always appreciate your feedback.

  • iv. If you have a lesson with your teacher at a regular time each week, please be aware that this may not always be possible, despite every effort being made by the teacher to make it possible.
  • v. If possible, please discuss the date/time of your next lesson with your teacher at the end of your lesson. If you cannot do this, please contact your teacher/us to arrange a suitable date/time for your next lesson.

This email will state in writing the date and time of your next lesson if it has been agreed verbally at the end of the lesson. • i. It is your responsibility as the purchaser of services provided by genuine-english.com to decide whether the services will meet your needs. Please contact us if you have any questions about the services we offer prior to making a payment for the provision of these services.
  • ii. The description of services is as set out in the Website, catalogues, brochures, or other form of advertisement. Any description is for illustrative purposes only.
  • iii. In the case of services made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.
  • iv. All services which appear on the website are subject to availability.
  • v. We can make changes to the services which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.

4. Customer responsibilities.

  • i. You must co-operate with us in all matters relating to the services, and provide us with all information required to perform the services.
  • ii. Failure to comply with the above is a customer default which entitles us to suspend performance of the services until you remedy it or if you fail to remedy it following our request, we can terminate the contract with immediate effect on written notice to you.

5. Your personal and financial details.

  • i. genuine-english.com uses website builder and online shop provided by IONOS Ltd., a trusted website and online shop provider in the UK. Some or all of your personal and financial details may be processed by 3rd parties when you purchase a product or service from the genuine-english.com shop. All details regarding this can be found either within our privacy policy or in the individual privacy policies of the 3rd party companies which process transactions on our website. The details of the 3rd party companies who process transactions and therefore may or may not process your personal and financial data will be available to you at the point of sale.
  • ii. genuine-english.com does not keep a record of your financial details and to the best of our knowledge does not have access to any financial information inputted into our online shop.
  • iii. We retain and use all information strictly under the privacy policy.
  • iv. We may contact you by using your email or other electronic communication methods and by pre-paid post and you expressly agree to this.
  • v. By using the website (including paying for products and services), you agree to the terms outlined in the Privacy Policy and various other legal statements available in the legal statements section of the website.

6. The writing review service is a bespoke service and therefore it may be possible that the details in sections 7 to 17 of this booking and cancellation policy do not apply to your purchase completely. The details in sections 7 to 17 of this policy are representative of a typical sale of this service and the standards that we aim to adhere to consistently.

7. Basis of sale.

  • i. The description of services on our website does not constitute a contractual offer to sell the services. When an order has been submitted on the website, we can reject it for any reason, although we will try to tell you the reason without delay.

  • ii. The order process is set out on the website. Each step allows you to check and amend any errors before submitting the order. It is your responsibility to check that you have used the ordering process correctly.

  • iii. A contract will be formed for the services ordered only when you receive an email from us confirming the order (the order confirmation). You must ensure that the order confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the order placed by you. By placing an order you agree to us giving you confirmation of the contract by means of an email with all information in it (i.e. the order confirmation). You will receive the order confirmation within a reasonable time after making the contract, but in any event not later than performance begins of any of the services.

  • iv. No variation of the contract, whether about description of the services, fees, or otherwise, can be made after it has been entered into unless the variation is agreed by the customer and the supplier in writing.

  • v. We intend that these Terms and Conditions apply only to a contract entered into by you as a consumer. If that is not the case, you must tell us so that we can provide you with a different contract with terms which are more appropriate for you and might, in some respects, be better for you, e.g. by giving you rights as a business.

8. Data Protection.

  • i. Your writing sample may be held on password protected email accounts, computers, and databases used by genuine-english.com
  • ii. Your piece of writing and personal data will be held in accordance with our Privacy Policy which is available in the legal statements section of genuine-english.com . It is accepted that by purchasing writing review services you agree to the terms of the Privacy Policy.
  • iii. We will not share your piece of writing or personal data with any third parties.

9. genuine-english.com will provide you with a quote prior to your purchase.

  • i. This quote will feature a price and expected deadline for the work to be completed.
  • ii. The quote will also outline the scope of the task and different prices for the various writing review services we offer.
  • iii. The quote will be valid for 30 days and will be related solely to the writing review brief you have submitted.
  • iv. Should you alter the writing brief substantially between the time that the quote is issued and the time that the work is to be carried out, we reserve the right to provide you with a fresh quote that is representative of the new piece of writing to be reviewed.

10. genuine-english.com will complete the work to the specifications requested by the deadline provided in the quote.

  • i. A deadline may look like this: “This task will be completed within 72hours of the 1st part payment being made”.
  • ii. In the unlikely event that the deadline in the quote is not going to be met, we will communicate this to you no less than 6 hours before the deadline.
  • iii. Please be aware that for payments made outside of working hours, the beginning of the countdown to the deadline won’t start until the moment the business is open again.

For example: If you make the payment on Saturday at 5pm UKT, the countdown to the deadline will not begin until Monday at 8:30am UKT. This is because the business is closed from 12pm UKT on Saturday to the following Monday at 8:30am UKT.

11. Payment and delivery process of writing review only purchases.

  • i. For those who have purchased a consultation alongside their writing review, the process is slightly different - please see section 12 for clarification.
  • ii. New customers and existing customers with writing review tasks worth over £100:
  1. You will be asked to pay half of the total writing review task price up front and the remaining cost upon completion of the task.
  2. Once a task is completed, you will be notified via email or phone. To receive the completed work, you must pay the remaining fee for the task.
  3. Once you have paid the remaining fee, the task will be sent to you within 2 hours.
  • iii. Existing customers with writing review tasks worth less than £100:
  1. You will be asked to pay half of the total writing review task price up front and the remaining cost upon completion of the task.
  2. Once the task is completed, it will be sent to you immediately.
  3. You must make the payment for the remaining cost of the task within 24 hours of the date and time that the writing review task is received in your email inbox (I.e. the time it is sent by genuine-english.com to you.)
  4. Failure to pay within 24 hours of receiving the completed writing review task will lead to you being considered as a new customer the next time that you request our writing review services.
  5. Failure to pay the remainder of the fee after a period of 30 days will lead to you receiving a final late payment demand letter with a final deadline to pay.
  6. Legal action may be taken if the payment is not made by the final deadline to pay.
  • iv. Existing customers with writing review credits or unredeemed lesson packs:
  1. If you currently have writing review credits or unredeemed lessons from a lesson pack purchase, they can be used to cover the cost of writing review tasks.
  2. You will be informed of the cost for the work in GBP and how many credits/lessons we would take from your account credits/unredeemed lessons to complete the writing review task if you decided to use your existing credits/unredeemed lessons to pay. You can then decide whether to use your credits or pay GBP for the writing review service.
  3. Upon completion, the agreed amount of credits/unredeemed lessons will be taken from your account and you will be sent an email update to inform you of your new credit/lesson balance at the same time that you receive your completed writing review task.

12. Payment and delivery process of writing review with consultation purchases.

  • i. Below is an outline of the payment and delivery process of a typical sale and provision of a writing review with a consultation.
  1. You enquire about the writing review with a consultation service, providing a sample of your writing and a description of it.
  2. We provide you with a quote outlining how many consultations we expect that you will need, a broken down price schedule for the review tasks and consultations, and a deadline for the whole task and consultation process to be completed.
  3. You make the payment for both the writing review and the consultations up front.
  4. We review your writing and return it to you.
  5. Then you can arrange your consultation with the genuine-english.com teacher who reviewed your writing.
  6. Your first consultation is held.
  • i) This is the end of the procedure for those who have purchased a single review and consultation. You will have had your piece of writing reviewed and a consultation with the teacher who reviewed it.
  • ii) For those who have booked several reviews and consultations you are then expected to rewrite your piece based on the recommendations given by the teacher in both the written review and the consultation. You are then expected to submit the amended version of your writing to be reviewed by a teacher again.
  • iii) This process of reviewing your amended piece of writing followed by arranging a consultation with the teacher who reviewed your writing is repeated if you have paid for several reviews and consultations related to the same task.

    7. If you require more consultations or reviews, you can purchase more and the process will continue as outlined above: payment - writing review - consultation.

13. No refunds are given after the purchase has been made.

  • i. As soon as you have agreed to the price quoted and made either a partial or full payment, there is no right to a refund. This is because the teacher may start working on the task from the moment the payment has been received. Please carefully consider the cost and scope of our writing review services before agreeing to the quoted price and making the payment. Once a payment is made, it cannot be refunded.

14. It is your responsibility to communicate with genuine-english.com if you would like to make changes to the writing review you have requested.

  • i. Changes to the writing review you have requested may incur a charge. Especially when additional work is needed.

15. How we calculate your writing review fee.

  • i. The factors we consider when calculating a writing review quote are:
  1. How much writing needs to be reviewed? (Amount of words)
  2. At first glance, how much work will need to be done to complete the writing review? (Quantity of errors/suggestions needed)
  3. What is the purpose of the writing that is being reviewed? (complexity of the task)
  4. Did the customer require colour-coded corrections or annotations? (Annotations take longer)
  5. Did the customer request a consultation? (Your teacher will need to prepare notes for the consultation while reviewing the piece of writing).
  • ii. We then calculate the amount of time it is likely to take, and provide a quote based on this.

16. On rare occasions quotes and deadlines may need to be amended.

  • i. genuine-english.com prides itself on delivering a great service at competitive prices. Despite our best efforts, from time to time, we may get a quote for a writing review task wrong. We reserve the right to request that the fee be increased if necessary to cover the time it will take to complete the work to the highest standard.
  1. If it is necessary to increase the fee, we will contact you via email or phone to discuss it with you.
  2. You can approve, negotiate with us, or decline the request.
  3.  If you decline the request to increase the fee, we will do the best we can with the time we have quoted to complete the writing review task, but it may be the case that the review is returned with a section that will be marked as ‘unreviewed due to time’. Thankfully, this is a very rare occurrence due to the expertise and experience of the English teacher reviewing your writing and the kind understanding of our customers.
  • ii. From time to time, deadlines can be too optimistic and may need pushing back. Thankfully this is also a very rare occurrence. However, if it is clear that your writing review is not going to be completed by the deadline we have set, we will tell you by email or phone no later than 6 hours before the deadline.
  1. If you have a very solid deadline for your work to be done, please ensure that you communicate that to us at every opportunity.
  2. If you have a very solid deadline for the work to be done, please make sure that our deadline is much earlier than the actual deadline you are personally working to. That way, there will be some wiggle room between the writing review being provided and your personal deadline for the piece of writing. You need this time because you will need to study the writing review we provide you with and make the amendments that we have suggested if you wish to do so.

17. Errors made when reviewing your piece of writing.

  • i. Despite every effort made by your writing reviewer to highlight and/or amend grammar/vocabulary/punctuation errors found in your piece of writing, occasionally, some errors may go unnoticed, and therefore will remain in the finished task that we return to you.
  1. You are advised to check your piece of writing thoroughly.
  2. In no event will genuine-english.com be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this writing review service.
  • ii. From time to time, we may make a suggestion or provide a correction that is incorrect.
  1. It is your responsibility to thoroughly check the writing review we provide you with.
  2. In no event will genuine-english.com be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this writing review service.
  • iii. Please bear in mind that it is an experienced and qualified English teacher reviewing your piece of writing. We do our very best to ensure that the task is done to the highest standard, but please take our suggestions and corrections with a pinch of salt. After all, you are the author responsible for the outcome of your piece of writing. Not us.

18. Complaints procedure.

  • i. genuine-english.com prides itself of delivering a fantastic service at a fair price. If you are dissatisfied with the writing review service you have received for any reason, please write your complaint to hello@genuine-english.com . We will respond to your complaint within 72 hours and try our best to come to an agreement on how best to proceed.
  1. We may provide a discount or offer to complete the writing review task (or particular sections of the task) again if you believe and can demonstrate that it has not been completed to the high standard we aim for.

  • ii. In the unlikely event that you are still dissatisfied after communicating with genuine-english.com , it is advisable that you consult The Consumer Rights Act 2015 at the following link: https://commonslibrary.parliament.uk/faulty-goods-digital-content-services/ . Here you will be able to learn more about your consumer rights and the possible options you have regarding your complaint.

  • iii. The contract (including non-contractual matters) is governed by the law of England, Wales, Scotland, and Northern Ireland.

19. Usage of AI (artificial intelligence) technology when reviewing your writing.

  • i. The writing review task is completed by a qualified and experienced human English teacher.
  • ii. Your genuine-english.com teacher will not submit your piece of writing into any AI-based writing review application or website.
  • iii. Your piece of writing will be worked on using basic word processing software (e.g. Pages, Microsoft Word, Google Docs etc.). Basic spellchecker software may be present on the word processor used.
  1. As basic word processors are likely to increase their utilisation of AI powered writing assistants over the coming years, it may be the case that some AI influence may be indirectly present in the reviewing of your writing. However, it is our intention to keep this to a minimum and rely on our human writing reviewing power over that of any AI machine. AI writing assistance will be disabled where possible and only used in a similar capacity as spellchecker software is used.

21. Excluding liability.

  • i. The supplier does not exclude liability for: (i) any fraudulent act or omission; or (ii) death or personal injury caused by negligence or breach of the supplier’s other legal obligations. Subject to this, we are not liable for (i) loss which was not reasonably foreseeable to both parties at the time when the contract was made, or (ii) loss (e.g. loss of profit) to your business, trade, craft or profession which would not be suffered by a consumer - because we believe you are not buying the services and goods wholly or mainly for your business, trade, craft or profession.

22. General.

  • i. If any court or competent authority finds that any provision of this booking and cancellation policy (or part of any provision) is invalid, illegal, or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this privacy policy will not be affected.
  • ii. This agreement will be governed and interpreted by the law of England, Wales, Scotland, and Northern Ireland. All disputes arising under the agreement will be subject to the exclusive jurisdiction of the English, Welsh, Scottish, and Northern Irish courts.
